Sargent Kenneth Harrelson from Titusville, Florida has wife and 4 children. Ken served in the Army and was medically retired. His son currently serves in the army as well.
He went to DC to work security for speakers of the scheduled events which would include some congressmen. On the 6th he along with others of the Oath Keepers escorted speakers to the permitted event area on Capital grounds only to find no stage or setup. This placed them just steps from the front of the Capital. Shortly after the people protesting moved on to the front steps. Ken along with the others working security moved closer to see what the commotion was about. He had remembered seeing a flyer for a protest on the Capital steps, so he assumed that is what is taking place. A so called “Storming” of the steps.
Later someone asked for help at the top of the stairs. Ken and his colleagues went to provide help. Once they got to the top the doors flung open and they moved inside the rotunda. As they walked in Ken noticed officers fist bumping protestors and seemed normal. Not finding the people or person in need of help they gathered for a prayer. After praying they found an officer, Harry Dunn, being verbally harassed by protestors. Ken notice Ofc Dunn was stressed and armed with a semi-auto rifle. Dunn made a comment to the rioters that he would “take them out with him”. Ken and his group positioned between the officer and the protesters to calm the situation. They protected him until some extra “hard unit” officers arrived and told them they, “got it from here”. They then left the Capitol voluntarily.
Ken returned home, but was arrested on March 10, 2021. He was charged with the following crimes:
- Conspiracy;
- Obstruction of an Official Proceeding and Aiding and Abetting;
- Destruction of Government Property and Aiding and Abetting;
- Entering and Remaining in a Restricted Building or Grounds;
- Tampering with Documents or Proceedings
January 12, 2022 a new indictment was issued that added the charge of Seditious Conspiracy. A very serious charge rarely used.
A trial was held in late 2022, in which the officer they assisted testified that they had in fact not helped. There were 302 reports that stated they assisted Dunn, but the judge would not allow them to be presented. The government presented another witness that state he witnessed Ken and party harassing Officer Harry Dunn. After the testimony the defense counsel reviewed CCTV video evidence that the witness did not arrive to the scene until after the period he testified as witnessing. They fought for the ability to present the evidence, but the judge claimed the officer was too busy to return to be questioned about it.
On November 29, 2022 a jury in Washington, DC acquitted him of the Seditious Conspiracy charge, but returned guilty verdicts on obstruction of an official proceeding, conspiracy to prevent an officer from discharging duties, and tampering with documents or proceedings.
Terrorism enhancement was added at sentencing and on May 26, 2023 Harrelson was sentenced to 48 months of incarceration federal prison followed by 24 months of supervised release.
